Terms of Use

These Terms of Use govern your use of the Moonwheel mobile application and related content and services.

1. Accepting these terms

By downloading, purchasing, or using Moonwheel, you agree to these terms and the Standard EULA. If you do not agree, do not use the app. If a child uses Moonwheel, a parent or legal guardian must review these terms and supervise the child’s use.

2. What Moonwheel provides

Moonwheel provides consumer audio and visual experiences such as sleep sounds, meditation audio, ambient sounds, bedtime stories, and downloadable content. Features and available content may change over time.

Moonwheel is not a medical device or healthcare service. It does not diagnose, treat, cure, or prevent any condition, and it is not a substitute for professional medical advice or emergency services. Do not use the app where audio or reduced alertness could be unsafe, including while driving or operating machinery.

3. License and permitted use

Subject to these terms and the Standard EULA, you may use Moonwheel and its content for personal, non-commercial use on supported devices associated with you. You may not copy, redistribute, sell, publicly perform, extract, reverse engineer, circumvent access controls, or create derivative commercial products from Moonwheel or its audio, artwork, text, or software except where applicable law expressly permits it.

4. Subscriptions and purchases

Moonwheel may offer auto-renewable subscriptions that unlock premium content or features. The purchase screen will show the subscription name, duration, content or services included, price, billing period, and any introductory or trial terms before you confirm a purchase.

• Payment is charged through your Apple Account when you confirm the purchase.
• A subscription renews automatically for the stated period unless you cancel it through Apple before renewal.
• If a free trial or introductory offer applies, the purchase screen will show its duration and the price that applies afterward.
• You can view, change, or cancel a subscription in Apple’s subscription settings.
• Deleting Moonwheel does not cancel a subscription.
• After cancellation, access generally continues until the end of the current paid period, subject to Apple’s subscription status.
• Billing, refunds, and purchase disputes are handled by Apple under its applicable terms and policies. You can contact Apple about billing or request a refund.

Prices, currencies, taxes, eligibility, and available plans may vary by country or region and are the amounts shown by Apple at purchase. Where available, use Moonwheel’s restore-purchases feature to restore eligible purchases made with the same Apple Account.

5. Downloaded content

Some audio or visual content may be downloaded for offline use. Downloaded content is licensed, not sold, and remains subject to these terms. Internet access may be needed for the initial download, purchase verification, restoration, or redownload. Availability may change for licensing, security, legal, or technical reasons. You are responsible for device storage and network charges.

6. Acceptable use

You must not misuse Moonwheel, interfere with its operation or content delivery, attempt unauthorized access, use automated extraction tools, defeat subscription or download controls, infringe another person’s rights, or use the service unlawfully.

7. Ownership

Moonwheel and its original software, branding, audio, artwork, stories, interface, and other content are owned by or licensed to Moonwheel and are protected by intellectual-property laws. No rights are granted except the limited right to use the app under these terms and the Standard EULA.

8. Third-party services

Moonwheel relies on services such as the Apple App Store for distribution and purchases and hosting providers for content delivery. Those services may have separate terms and may be unavailable or changed independently of Moonwheel.

9. Availability and changes

We aim to keep Moonwheel available and reliable, but do not promise uninterrupted or error-free operation. We may add, change, suspend, or remove features or content for operational, legal, safety, or licensing reasons. We will not remove paid access contrary to applicable law or Apple’s rules.

10. Disclaimers and liability

To the maximum extent permitted by law, Moonwheel is provided “as is” and “as available.” The warranty disclaimers and liability limits in the Standard EULA apply. Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

11. European Union and other mandatory consumer rights

If you live in the European Union, European Economic Area, United Kingdom, or another jurisdiction with mandatory consumer protections, those protections remain unaffected. For users covered by the Standard EULA’s country-specific provisions, applicable law and courts are determined as stated in the Standard EULA, including the protections connected to a user’s usual place of residence where applicable.

App Store billing and any applicable cancellation or withdrawal process for digital purchases are administered by Apple under the Apple Media Services terms presented for your country or region.

12. Termination

You may stop using Moonwheel at any time. Your license may terminate if you materially violate these terms or the Standard EULA. Provisions that by their nature should survive termination—including ownership, disclaimers, and liability provisions—will survive.

13. Changes to these terms

We may update these terms as Moonwheel changes. We will post the revised terms here and update the date above. Where required, we will provide additional notice or obtain consent.
